Under the Intermediaries Byelaw, managing agents may delegate authority to determine claims only to specific categories of firms. Any claims handling provider appointed by a managing agent that does not fall within one of the categories expressly listed in the Byelaw must obtain prior approval from Lloyd’s as a Delegated Claims Administrator (DCA). This requirement applies to most third-party claims handling providers. Efektiv Group is approved by Lloyd’s as a DCA and is therefore authorised to determine claims within the meaning of the Intermediaries Byelaw, including all activities necessary to accept or deny a claim in whole or in part, agree the amount payable, and finally resolve claims by agreement or, where necessary, through dispute resolution. Efektiv Group is also a member of ECAN, a pan-European network of claims administrators and independent experts that enables insurers, brokers and international companies to manage cross-border claims efficiently through the involvement of local experts, in full compliance with applicable national regulations. This membership further enhances Efektiv Group’s ability to support clients across Europe with a high level of expertise, coordination and regulatory compliance. For the avoidance of doubt, DCA approval is required only for firms appointed to determine claims. Loss adjusters and other service providers that provide advisory or support services without authority to determine the outcome of a claim do not require such approval. Similarly, managing agents, law firms (subject to applicable registration requirements), and coverholders handling claims on policies they have underwritten are not required to obtain DCA approval.
