Under the Intermediaries Byelaw, managing agents may delegate authority to certain categories of firms to determine claims. Firms appointed by managing agents that do not fall within one of the categories expressly listed in the Byelaw must obtain prior approval from Lloyd’s as a Delegated Claims Administrator (DCA).

This requirement applies to most third-party claims handling providers. Efektiv Group is approved by Lloyd’s as a Delegated Claims Administrator (DCA). As such, Efektiv Group is authorised to determine claims within the meaning of the Intermediaries Byelaw, including carrying out all claims handling activities necessary to: (i) accept or deny a claim in whole or in part; (ii) agree the amount payable; and (iii) resolve finally any open matter by agreement or, where necessary, through dispute resolution.

For the avoidance of doubt, only firms that are appointed to determine claims require DCA approval. Loss adjusters and other service providers who merely advise on or support claims handling activities, without authority to determine the outcome of a claim, do not require prior approval.

Likewise, managing agents, law firms (subject to registration requirements), and coverholders handling claims on policies they have underwritten do not require DCA approval.
